Privacy Policy for Logistware Inc.This Privacy Policy describes how Logistware Inc. (“we,” “us,” or “our”) collects, uses, and discloses your information when you use our website and mobile application (the “Platform”). We operate as a technology-based Load Board facilitating connections between Shippers and Carriers.
By using the Platform, you agree to the collection and use of information in accordance with this Privacy Policy and the Personal Information Protection and Electronic Documents Act (PIPEDA).
Information Collection and Categories
To operate the Logistware marketplace, we collect the following:
- Business Profile Data: Company names, addresses, DOT/MC numbers, CVOR/NSC safety ratings, and business phone numbers/emails.
- Contact Information: Names, phone numbers, and email addresses of dispatchers, drivers, and shipper representatives for communication and manual vetting.
- Shipment and Bidding Data: Details of shipments posted, bidding history, and final rate confirmations.
- Document Data: Digital copies of Certificates of Insurance (COI), Shippers’ Agreements, and Proof of Delivery (POD) uploaded by users.
- Geolocation Data: Real-time GPS coordinates of drivers while they are assigned to an active shipment via the Logistware mobile app.
Use of Data and “Meaningful Consent”
We use your information for the following identified purposes:
- Platform Facilitation: To allow Shippers to post loads and Carriers to bid on them.
- Manual Vetting: To verify the identity and authority of new users to maintain platform integrity.
- Communication: To enable internal communication between Shippers and Carriers regarding active shipments.
- Real-Time Tracking: To provide Shippers with visibility into the location of their freight and to allow Carriers to manage their fleet.
- Compliance: To maintain records required for tax and transportation audits.
Data Exchange and Bidding Security
The Platform serves as a secure conduit for document exchange:
- Restricted Access: Documents such as COIs and Shippers’ Agreements are only visible to the specific parties involved in a bid acceptance.
- User Responsibility: Once documents are exchanged, the Shipper is responsible for final verification. Logistware Inc. does not own or guarantee the accuracy of documents exchanged between users.
GPS Tracking and Driver Privacy
Real-time tracking is essential for the security and efficiency of the shipment process.
- Carrier Obligations: Carriers warrant that they have obtained express, written consent from all Drivers to be tracked via the Logistware app prior to assigning them to a load.
- Active Tracking: Geolocation data is only collected while the Driver is engaged in a shipment assigned through the Platform.
- No Third-Party Sale: We do not sell GPS location history to third-party marketing or data-mining firms.
Data Disclosure
We share your information only in the following ways:
- With Other Users: Limited contact and profile information is shared between Shippers and Carriers to facilitate bids and shipment execution.
- Service Providers: We share data with trusted third parties (e.g., cloud hosting and map services) who assist in platform operations under strict confidentiality agreements.
- Legal Requirements: We may disclose data if required by law, subpoena, or to protect the safety of our users or the public.
Data Retention (The 7-Year Rule)
In accordance with Canadian tax laws (CRA) and the statute of limitations for commercial contracts:
- Shipment Records & Logs: We retain shipment details, communication logs, and document exchange history for a period of seven (7) years from the date of the transaction.
- Purpose of Retention: This ensures that both the User and Logistware Inc. have the necessary evidence to defend against future legal claims, audits, or disputes.
Data Security
We implement industry-standard administrative, technical, and physical safeguards (including SSL encryption) to protect your data. However, as Logistware Inc. is a digital platform, we cannot guarantee 100% security against sophisticated cyber-threats. Users are responsible for maintaining the security of their login credentials.
Your Privacy Rights
Under PIPEDA, you have the right to:
- Request access to the personal information we hold about you.
- Request the correction of inaccurate or incomplete data.
- Withdraw consent for tracking (noting that this may result in the inability to use the Platform for active shipments).
